Guam – A hearing has been scheduled in Superior Court this Wednesday, February 26, on a “declaratory judgement” sought by the Legislature on the use of money in the Tax Refund Trust Account.
The court action was authorized by a Legislative Resolution passed during the last Session. Resolution 312 seeks a decision from on withdrawals from the Refund Trust Account.
Appropriations Chair Senator Ben Pangelinan believes the money must be left in the account and can only be used to pay refunds. The Administration disagrees.
Pangelinan announced Friday that a private attorney, John Terlaje, has been hired to seek file the petition with the Guam Supreme Court.
The hearing will be held at 9:30AM in the court room of Presiding Judge Alberto Lamorena.
