There will be no trial in the case involving the kidnapping and assault of Piatra Tuncap as negations on a deal were reached late yesterday afternoon.
“He wishes to apologize to Ms. Pia Tuncap as well as her parent and stepfather for what has occurred,” stated attorney Doug Moylan on behalf of his client, Brian Kevin Cruz.
Cruz will plead guilty to family violence as a felony and felony while on felony release as part of the deal with the government. Moylan put it on the record, stating that the formal plea will be submitted to the court.
The deal calls for the dismissal of the car theft-related charges and credit for time served. Cruz is facing a sentencing range of 8 to 18 years based on the deal.
Superior Court Judge Vernon Perez has set a change of plea hearing for Jan. 7.
