Guam – David L. Asuncion stood before the Honorable Steven S. Unpingco yesterday [Thursday] and changed his plea to guilty to Murder as a First Degree Felony in the 2009 Homicide of Mr. Oscar Untalan Garcia.
On August 11, 2009, an argument occurred between David Asuncion and Oscar Garcia. Both had been consuming alcoholic beverages while at a residence in Dededo. Asuncion had retrieved a large kitchen knife and stabbed Mr. Garcia. Emergency room doctors informed the police that the stab wound had severed a vital artery, in which the victim died the following evening. Asuncion later admitted to police that he had stabbed Garcia.
According to Prosecuting Assistant Attorney General Stephen Leon Guerrero, “Asuncion will be sentenced to life imprisonment with the possibility of parole only after serving 25 years of direct jail time.” He continued, “The defendant accepted responsibility by entering into this plea and in someway this brings closure to the victim’s family and allows them to move on in their lives.”
Attorney General Leonardo M. Rapadas added, “Justice has been served. I also believe that the police performed exceptionally in this matter and together with the Office of the Attorney General yielded these results.” In addition, “I can only hope that this provides some form of closure to the victim’s family.”
