DOC escapee arraigned

Johnny Atalig was indicted by a grand jury last Friday on the charge of felony escape as a third-degree felony.

The two inmates who escaped DOC custody appeared in court this afternoon for an arraignment hearing.

Johnnie Del Rosario and Johnny Atalig were indicted by a grand jury last Friday on the charge of felony escape as a third-degree felony. Today, Atalig appeared before Superior Court Judge Jonathan Quan to answer to the charge against him.

“Yes, your honor, on behalf of Mr. Atalig, we waive a reading of the indictment, enter a plea of not guilty to the single charge therein, request all discovery, the grand jury disc forwarded to my office. A jury of 12 is requested in this matter. At this time, Mr. Atalig would be waiving his right to a speedy trial although we understand that the co-defendant has asserted,” Atalig’s lawyer stated.

On Oct. 9, the two men were dressed in civilian clothing when they made their escape, walking out of the prison which does not have a CO stationed at the main entrance and entered into a brown American-made truck.

The following day, the two men called the warden of the prison and self-surrendered.

It should be noted that the driver of the vehicle who assisted in their escape has not yet been identified nor charged.

The next hearing is set for Oct. 3 at 9:30 a.m. before Judge Arthur Barcinas.
