Judge turns down request for release

Roger Balicha, who is accused of drug possession, appeared in court to answer to a 13th violation of pre-trial release conditions.

Roger Balicha was quickly turned down by Superior Court Judge Anita Sukola when he asked to be released from custody at a violation hearing this afternoon.

Balicha, who is accused of drug possession, along with former Guam Police Department officer Jason Ortiola, appeared in court to answer to a 13th violation of pre-trial release conditions.

While the court indicated that a plea deal signed by Balicha could be denied by the court because of his continued violations, it appears that revocation will not happen just yet.

Sukola acknowledged that the probation office is requesting for revocation or a 60-day stint in jail for the violation. But she stated that Balicha needs help.

She continued the hearing until tomorrow to provide probation time to confirm if Balicha has made efforts to take part in the Lighthouse recovery program. The hearing is set for 1 p.m.
