Superior Court Judge Vern Perez Assigned to Gutierrez Election Lawsuit Case


Guam – Superior Court Judge Vern Perez has been assigned to hear the lawsuit filed by the Gutierrez-Aguon team which seeks a declaration that the Gubernatorial results certifying Eddie Calvo and Ray Tenorio as the Governor and Lt. Governor elects are “legally invalid.”

Superior Court Spokeswoman Maria Cenzon says that Judge Perez was the first Judge to be assigned the case and he has not recused himself. No hearing date has been scheduled, yet.

Meanwhile, no Judge has been assigned yet in the companion lawsuit filed in District Court. District Court Judge Francis Tydingco-Gatwood has recused herself because her brother, Dan Tydingco, is a member of the Calvo-Tenorio transition team. Judge Tydingco-Gatewood has referred the case to Alex Kozinski, Chief Judge of the U.S. Court of Appeals for the 9th Circuit, who will designate another federal judge to preside.
