Kidnapping trial moved to December

Brian Kevin Cruz will have to wait another month before he stands trial for kidnapping and assault.

Trial in the case involving the kidnapping and assault of a woman who was held captive for 24 hours by her estranged boyfriend will not move forward this week.

Brian Kevin Cruz will have to wait another month before he stands trial for kidnapping and assault. His attorney Doug Moylan made the request to postpone the trial this morning.

“Your honor, I had reset my schedule several months ago in order to go to trial on October 30th this Wednesday. I understand that Mr. O’Mallen and the court has current trials that they are in I respectfully ask that we push this trial to the beginning of December,” Cruza said.

With no objections from the government, Superior Court Judge Vernon Perez indicated that he didn’t want to see this case be pushed further back than by several weeks, eyeing December 11th as a trial date. A continued PTC has been set for November 25th at 8:30 a.m.
