Man accused of Toto murder appears in court

Accused in the rape and beating death of a woman on Ramirez street in Toto, Katner Herry appeared before Superior Court Judge Anita Sukola who has taken over the adjudication of the case.

Herry’s attorney Anne Gayle informed the court that a subpoena was issued to the general manager of the Mobil gas station in Toto. She says that the gas station may have surveillance video evidence related to Luciana Polly’s death.

The complaint against Herry states that while proceeding to the gas station, he was told by Polly to wait for her and that he fell asleep waiting for her.

The location he was told to wait at was Ramirez street where Polly was later discovered deceased.

Gayle also noted that she would be filling motions early on in the case. However, she did not stipulate what type of motions they would be.

Herry has waived his right to a speedy trial and his next hearing is set for March 16.
