OPA Denies PDS Appeal, Affirms DOE’s Decision to Award $2M Computer Contract to Softchoice


Guam – Public Auditor Doris Flores Brooks has rejected a procurment appeal from PDS and affirmed the Department of Education’s decision to award a $2M dollar contract to Soft Choice for more than 3-thousand computers.

In a decision rendered Thursday, Brooks says she made the move in the “best interests of the territory” because the $2 million in funding for the contract is being provided by the federal government through ARRA dollars.

She adds termination, cancelation or nullification of the contract would have resulted in the loss of the federal funds.

Pacific Data Systems filed a protest last month, arguing that DOE unfairly disqualified them from the bid and modified bid amounts submitted by Soft Choice and another bidder, ComPacific.

A hearing was held on Monday at the Public Auditor’s Office with representatives from PDS and DOE. However, no representatives were present for Soft Choice or ComPacific.

Brooks also dissolved a stay she had earlier issued on the procurement process.
